Terms of Service

1. Scope and provider

These terms govern the use of Ludowish, operated by Mind63 GmbH, Römerstr. 76/1, 74078 Heilbronn, Germany. The full provider details are in the legal notice.

Ludowish is a platform for creating wishlists, sharing them and reserving other people's wishes. Ludowish is free. Nothing is bought through Ludowish: wishes link to third-party offers, and the purchase happens there.

Terms of your own apply only if we agree to them in writing.

2. How the agreement comes about

The agreement comes about when you create an account and accept these terms. There is no right to an account. As a guest you can view shared lists and reserve without an account; sections 6, 8, 9 and 12 then apply to you accordingly.

You confirm that the details you give when registering are correct, in particular your date of birth. An account is personal; do not pass on your credentials, and tell us if you suspect misuse.

3. Account types and age

There are adult accounts (18 and over), teen accounts (13 to 17) and child profiles (under 13) inside a parent account. When you sign up we ask for your date of birth neutrally, without showing the age thresholds.

Teenagers below the threshold in their country need a parent's approval. Until it arrives, sharing, following and public visibility are locked; lists and wishes you can already create. Without approval we delete the account after 30 days.

A child profile is created by a parent only, who consents under Art. 8 GDPR while doing so. Child profiles have no e-mail address, are never public and cannot be found by search.

4. Guardian access

Parents manage child profiles fully: visibility, followers, paired devices, PIN, data export, pausing and deletion. Teen accounts they manage in a limited way: pause, delete, data export. They have no insight into the teenager's lists, followers or activity.

From the age threshold of their country, the teenager can end guardian access themselves. We inform the parent when that happens.

5. Your content

You are responsible for titles, notes, uploaded images and profile details. You confirm that you hold the necessary rights, in particular to images, and that you infringe nobody else's rights.

Your content stays yours. You grant us only the right to store it technically, to resize and convert it, and to show it to the people you make it available to through your visibility setting. That right is non-exclusive, not transferable, limited to running Ludowish, and it ends when you delete the content.

6. Prohibited use

The following are not allowed, in particular:

  • unlawful content, insults, threats, harassment and incitement
  • content that endangers minors, and any sexualised approach to a minor
  • contacting children under a false identity
  • fraud, phishing, advertising, chain letters and automated mass account creation
  • scraping the platform, circumventing limits or technical protections
  • links to malware or to offers that break applicable law

Wishes may link to shops. A link on a blocklist is marked as such and cannot be saved at all for a child profile.

7. Reporting, moderation and measures

Anyone, including people without an account, can report profiles, lists and wishes. Reports involving minors are handled first. The procedure is described in the community guidelines.

Where the rules are broken we may, graded by severity and repetition: remove content, issue a warning, restrict features, pause the account or block it. We tell you what we did and why, unless a legal provision forbids it. You can object to a measure at support@ludowish.com; a human will then review it again.

8. Reservations

Reserving a wish expresses the intention to give it. A reservation is not an order, not a contract and not a payment obligation, neither towards us nor towards the person whose list it is. Reservations can be cancelled at any time.

9. Shop links and affiliate links

Wishes link to third-party offers. We accept no liability for their content, prices, availability or terms, and we do not monitor them continuously. Prices and images we show are a snapshot from the moment we fetched them and may be out of date.

Some links carry affiliate parameters. If you buy through one, we may receive a commission. Such links are marked "affiliate link". They cost you nothing extra, and we transmit nothing that identifies you.

10. Availability and changes to the service

We aim for reliable operation but owe no particular availability. Maintenance, further development and the retirement of individual features are possible. We announce material restrictions with reasonable notice where that is reasonable for us.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

For slight negligence we are liable only for breach of a material obligation, that is an obligation whose fulfilment makes proper performance possible in the first place and on whose observance you may regularly rely. In that case liability is limited to the foreseeable damage typical for this kind of agreement.

For loss of data we are liable only up to the effort that recovery would have taken had you kept proper and regular backups. Use the data export in your settings for that.

12. Term and termination

The agreement runs for an indefinite period. You can delete your account at any time and without notice in your settings; a 14-day grace period follows in which signing in cancels the deletion.

We may terminate with 14 days' notice in text form. The right to terminate for cause, in particular for serious or repeated breaches of section 6, remains unaffected.

13. Changes to these terms

We may change these terms where there is an objective reason, such as a change in the law, in case law, new features or security requirements.

We announce changes at least 30 days in advance and present them to you at your next sign-in. If you do not object before they take effect, or if you keep using Ludowish afterwards, they count as accepted. We point that out expressly in the announcement. If you object, the agreement ends when they take effect; you can export your data before then.

Every version carries a version number, and we record which one you accepted and when.

14. Data protection

How we handle your data is set out in the privacy policy. It is not part of these terms but information under Art. 13 GDPR.

15. Withdrawal

Ludowish is free of charge. Absent a paid contract there is no statutory right of withdrawal. You can delete your account at any time under section 12.

16. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country you live in remain unaffected.

Should a provision be invalid, the rest remains in force.

Declarations in text form, in particular by e-mail, suffice for everything these terms require.
